In a significant escalation of its enforcement strategy, the Brazilian Ministry of Justice and Public Security (MJSP) has officially notified Google and Apple regarding the presence of unlicensed gambling applications on their respective platforms.

The notification, issued on 18 April 2026, demands that the tech giants take immediate action to identify and remove betting apps that do not comply with the new federal regulatory framework. This move signals a shift from targeting operators directly to targeting the digital infrastructure that allows them to reach Brazilian consumers.

Cutting Off the Digital Supply Chain

The MJSP’s action, spearheaded by the Secretariat for Rights and Public Safety, aims to protect consumers from platforms that offer no financial guarantees or responsible gaming safeguards.

  • Platform Accountability: By notifying Google and Apple, the Brazilian government is leveraging the gatekeeper status of app stores to enforce local laws.
  • Consumer Protection: The Ministry highlighted that many of these illegal apps bypass national age-verification standards and do not comply with the upcoming restrictions on VIP programs and gamification.
  • Grey Market Erasure: This is a crucial step in the transition to a fully regulated market, ensuring that only tax-paying, licensed entities are visible to the public.

A Global Trend: Regulators vs. Big Tech

Brazil’s approach mirrors a growing global trend where gambling regulators no longer rely solely on IP blocking but instead demand cooperation from multinational tech companies.

  • The Philippine Parallel: This omnibus style of enforcement, targeting every link in the chain, was recently seen in the Philippines’ unified POGO ban strategy, which also coordinates multiple government departments to dismantle illegal networks.
  • The Visibility Battle: Brazil’s move is a direct response to the same blind spot challenges identified by the UKGC. As players increasingly use VPNs to access offshore sites, removing the apps from local stores is seen as the most effective friction to prevent casual engagement.
  • Standardising Safety: Much like the ACMA’s recent warnings in Australia, the Brazilian Ministry is concerned that automated app notifications and personalised promos from unlicensed apps are bypassing the country’s new marketing safeguards.

Impact on the 2026 Market Launch

For operators currently in the process of securing a federal license in Brazil, the MJSP’s notification is a welcome development. It ensures a level playing field by removing competitors who avoid the costs of compliance and taxation.

However, for B2B providers and developers, it emphasises the need for geofencing and strict store-compliance protocols. The Brazilian government has made it clear: if an app is available to a Brazilian IP but lacks a federal license, it is considered a criminal enterprise.

As Brazil moves closer to its full market activation, we can expect further collaboration between the Ministry of Finance and the Ministry of Justice to ensure that the strict advertising standards seen in Belgium and the Netherlands are mirrored in the digital app ecosystem.
