The Indian government has clarified that software providers offering games under the esports category must complete formal assessment and registration with the Online Gaming Authority of India (OGAI). In a written parliamentary response submitted to the Lok Sabha, Minister of State for Electronics and Information Technology Jitin Prasada confirmed that title-by-title determinations are required to distinguish legitimate skill-based esports from banned online real-money games.

The clarification enforces the statutory framework established under the Promotion and Regulation of Online Gaming (PROG) Act 2025 and its 2026 subordinate rules.

Core Operational Provisions for Esports Registration

The Ministry of Electronics and Information Technology (MeitY) outlined specific structural mechanisms governing competitive video game registration and compliance:

  • Title-Specific Applications: Every game provider must individually apply for determination to verify whether a product qualifies as an esport, an online social game, or an illegal money game.
  • National Sports Governance Alignment: A game must first secure recognition under the National Sports Governance Act 2025 before the OGAI can issue formal esports registration.
  • 10-Year Certificate Validity: Titles that successfully pass the 90-day determination review receive a formal certificate of registration valid for up to 10 years, subject to compliance reviews.
  • Exclusion of Monetised Stakes: Any game containing entry fees, financial deposits, or monetary payouts is automatically barred from obtaining esports classification.
  • Distinct Social Games Track: Non-real-money social games are exempt from mandatory registration unless specifically designated by central government notifications or authority directives.

Real-Money Game Bans and Foreign Market Impact

The clarification provided to Parliament emphasises the central government’s policy of separating competitive, skill-based esports from wagering operations. Under current legislation, all real-money gambling platforms face strict statutory prohibitions. Major policy shifts occurred when India’s MeitY enacted an online money gaming ban, effectively removing real-money stakes, fantasy sports pools, and pay-to-play casino games from domestic app stores.

The federal ban extends to financial event contracts and foreign exchanges attempting to operate in the region. International platforms faced immediate regulatory boundaries when Kalshi blocked India’s prediction market operations following official regulatory notices.

Consumer Trends and Advertising Shifts

The prohibition on domestic real-money platforms has significantly reshaped consumer behaviour and digital ad channels across India. Comprehensive market studies show how India’s online gaming ban pushes players offshore, leading authorities to step up enforcement against unauthorised operators. In response, federal law enforcement agencies moved aggressively when India blocked 242 illegal online gambling sites under PROGA to curtail illicit cross-border gambling traffic.

Simultaneously, major tech platforms have adjusted their advertising policies to align with domestic legislative mandates. The commercial landscape shifted further when Google Ads prohibited rummy and fantasy sports advertising in India, restricting paid search visibility strictly to non-monetised titles.

Strategic Impact on Game Publishers and Tournament Organisers

By creating a formal registration pathway for esports while maintaining an absolute ban on real-money wagering, India aims to build a publisher-led competitive gaming industry. To maintain active registration, registered esports publishers must implement mandatory user-safety mechanisms, including two-tier grievance redressal systems, parental controls, and age verification protocols.

For global publishers, tournament organisers, and broadcasting partners, the OGAI determination process provides legal clarity. Once a title obtains a 10-year registration certificate, it operates under clear federal sports and technology protections, completely isolated from real-money gaming enforcement actions.
