The Massachusetts Gaming Commission is reviewing how DraftKings uses artificial intelligence and machine learning in its sportsbook operations, with particular attention to promotional targeting and customer analysis. The regulator also plans to examine AI practices across other licensed sports wagering operators in the state.

During its 24 September open meeting, the Massachusetts Gaming Commission said staff would engage with DraftKings to understand better the practices that raised concerns. The review has not found wrongdoing by DraftKings.

The findings raised questions about how automated analysis can influence customer engagement and what safeguards may be needed when technology informs player-facing decisions.

US Marketing Standards Add Another Layer

AI-driven promotions also sit within a broader debate about responsible gambling marketing in the United States.

In August, ROGA introduced a US online gaming marketing and advertising code covering areas including promotional accuracy, legal-age audiences and targeted marketing. The framework also addresses AI-assisted communications, requiring participating operators to avoid directing targeted marketing towards customers flagged through responsible gaming protocols.

For sportsbook operators, this creates a growing compliance overlap between marketing technology and player protection. Systems designed to personalise offers may need to account not only for commercial performance but also for whether a customer has displayed indicators requiring additional safeguards.

That could place greater emphasis on how operators document automated decisions and how compliance teams oversee tools supplied by external technology partners.

Regulators Build Governance Around Gambling AI

Massachusetts is not alone in examining how gambling businesses deploy artificial intelligence. The Malta Gaming Authority recently launched an AI Gaming Charter focused on responsible, transparent and accountable use of the technology across gaming operations.

That framework covers areas including player protection, customer interaction, fraud detection and operational decision-making, showing how AI governance is expanding beyond technical teams and into compliance functions.
The Massachusetts review could therefore indicate how regulators expect sportsbooks to document and oversee automated decision-making.
