Stake Wins Temporary Court Relief to Operate in Brazil Until October 25
Court Preserves Stake Authorisation Until October 25
The 9th Federal Civil Court of São Paulo issued the partial injunction after Stake challenged the implementation of Provisional Measure 1,394.
Stake had sought protection through the end of 2029, when its federal authorisation was originally due to expire. The court declined that request but concluded that the operator’s authorisation should not be treated as terminated before October 25, the date corresponding to the transition period established by the measure.
The court said:
The authorisation remains provisionally effective until October 25 2026.
The ruling also prevents authorities from blocking or redirecting Stake’s Brazilian domain solely because its authorisation was terminated earlier during that period.
Brazil’s Ministry of Finance explains in its official guidance on Provisional Measure 1,394 that the measure prohibits fixed-odds sports betting and online gaming nationwide.
Ruling Does Not Suspend Brazil’s Betting Ban
For operators, the distinction is important. The judgment does not overturn the framework described in the earlier Brazil betting ban timeline or automatically extend similar protection to other licence holders.
Most regulated platforms have already moved through the shutdown process, with the market entering a player refund phase after betting sites became unavailable from October 6.
Stake’s case instead focuses on whether an authorised operator could lose the practical benefit of its licence before the transition period itself had expired.
The dispute adds another judicial dimension to Brazil’s rapidly changing gambling environment. Courts are already considering other betting-related challenges, including a separate case requiring the government to provide more detail on claims linking licensed operators to public health costs.
